A Spanish youth court recently handed down a one-year probation sentence to 15 minors who created and shared AI-generated nude images of their female classmates in two WhatsApp groups. The court charged the teens with multiple counts of creating child sex abuse images and offenses against their victims’ moral integrity. Along with probation, the court ordered the teens to attend classes on gender, equality, and the responsible use of information and communication technologies.

The victims of this disturbing incident were initially too ashamed to speak out as the fake images circulated. The mother of one victim shared that her daughter and others experienced severe anxiety and fear in silence. The court revealed that the teens utilized artificial intelligence to create images where their female classmates appeared naked by superimposing their faces onto other nude bodies sourced from social media profiles.

Using AI to sexualize and harass classmates is a growing global concern, with investigations into similar cases happening in the US and the EU. The European Union has proposed expanding the definition of child sex abuse to address deepfakes and AI-generated content. Victims of these incidents not only suffer mental health impacts but also struggle with trust issues and fear of further harassment.

The spread of fake child sex abuse materials created using AI poses significant risks, as these images can potentially end up on the dark web. The Internet Watch Foundation reported a concerning number of AI-generated images on dark web forums, prompting calls for more robust measures to combat the proliferation of deepfakes. Lucia Osborne-Crowley suggested regulating sites that generate and share deepfake content, while the Malvaluna Association emphasized the importance of education in preventing teens from using AI to harm others.

In addition to legal consequences for the teens involved, there are calls for tech companies to take more proactive measures in combating the spread of harmful deepfakes. While WhatsApp claims to have a zero-tolerance policy for child sexual exploitation, there is a need for clearer guidelines on addressing AI-generated content.

The incident in Spain serves as a stark reminder of the dangers posed by the misuse of AI and the urgent need for stricter regulations and enhanced education on responsible technology use. By addressing these issues comprehensively, we can work towards creating a safer and more respectful online environment for everyone.
